1. Service Interruptions and Data Loss

WealthPath relies on complex software architecture and third-party cloud infrastructure (including but not limited to Firebase, external database hosting, and cloud service providers). While we strive for maximum uptime and reliability, we cannot guarantee uninterrupted access to the platform or the absolute preservation of your data.

WealthPath shall not be held responsible or liable for any data loss, service interruptions, outages, delays, or unavailability caused by:

• Failures or downtime of third-party providers (e.g., Firebase, Vercel, AWS, or market data APIs).
• Internet service provider failures, network congestion, or routing issues.
• Cyberattacks, hacking, ransomware, or unauthorized access to our systems or our providers' systems.
• Technical failures beyond our reasonable control, including hardware or software malfunctions.
• Force majeure events such as natural disasters, governmental actions, strikes, or civil unrest.

2. User Responsibility for Data Backups

Users are strictly responsible for maintaining independent backups of their important information, including portfolio allocations, transaction histories, personal notes, and analytics. WealthPath is not designed to function as a secure data storage facility or an official system of record. In the event of catastrophic data loss, WealthPath is under no obligation to restore lost user data.

3. Accuracy and Timeliness of Market Data

WealthPath aggregates financial data from external sources and APIs. This includes stock market quotes, IPO (Initial Public Offering) data, mutual fund NAVs, financial news, analytics, and portfolio tracking information. You acknowledge that:

• Market data may experience significant delays, inaccuracies, or interruptions from external providers.
• Financial news and analytics are algorithmically generated or aggregated and may not reflect the most current market realities.
• We do not warrant the accuracy, completeness, or timeliness of any financial data presented on the platform.
• You should independently verify all market information through official exchanges or certified financial advisors before making any investment decisions.

4. Limitation of Liability

To the fullest extent permitted by applicable law, WealthPath, its affiliates, officers, directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, anticipated savings, investment opportunities, business interruption, goodwill, or data, arising out of or relating to the use of, or inability to use, the WealthPath platform, services, content, market data, analytics, or third-party integrations.

WealthPath provides informational and educational content only and does not guarantee the accuracy, completeness, timeliness, or reliability of any market data, stock information, investment insights, news, or analytics presented on the platform. Users acknowledge that all investment decisions are made at their own risk.

In no event shall WealthPath's total aggregate liability for any claim arising from or related to the platform exceed the amount paid by the user to WealthPath during the twelve (12) months preceding the event giving rise to the claim, or INR 1,000, whichever is greater.

Nothing in these Terms shall exclude or limit liability that cannot be excluded or limited under applicable law, including liability for fraud, willful misconduct, or any other liability that applicable law prohibits from being excluded.

5. Indemnification

You agree to indemnify, defend, and hold harmless WealthPath, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account) violation of these terms, your use of the platform, or your infringement of any intellectual property or other right of any person or entity.

6. Governing Law and Dispute Resolution

This Disclaimer and any disputes arising out of or related to it shall be governed by and construed in accordance with the laws of Delaware, USA, without regard to its conflict of law principles. Any legal action or proceeding related to this platform shall be brought exclusively in a court of competent jurisdiction located in Delaware, and you consent to the jurisdiction of such courts.
